  3. You will use the Platform in a manner consistent with any and all applicable local, state, national, and international laws and regulations.

3. Jurisdictional Restrictions: It is your responsibility to determine whether your jurisdiction permits the use of the Platform. “Multiwealth Global” does not make any representation that the Platform is appropriate or available for use in jurisdictions outside of the country of its operation. You must ensure that your use of the Platform complies with local laws and regulations.

4. No Financial Advice: “Multiwealth Global” is an AI-based algorithmic trading platform and does not offer financial advice. Any information or services provided by the Platform should not be interpreted as investment advice or recommendations. Trading carries risks, and you should seek advice from a qualified professional before making any investment decisions.

5. Limitation of Liability:“Multiwealth Global” and its affiliates, partners, or licensors shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from your use of the Platform.

6. Service Modification and Termination: “Multiwealth Global” reserves the right to modify, suspend, or discontinue the Platform with or without notice at any time and without any liability to you.

7. Data and Privacy: Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, and protect your information.

8. Dispute Resolution: Any disputes arising out of or relating to these Terms or the Platform shall be resolved in accordance with the laws of United Kingdom and you agree to the exclusive jurisdiction of its courts.

9. Changes to Terms: “Multiwealth Global” reserves the right to amend or update these Terms of Use at any time. Your continued use of the Platform following any changes means that you accept and agree to the revised terms.

10. Intellectual Property: All intellectual property rights in and to the Platform, including but not limited to the algorithms, software, user interface, and trademarks, are owned by or licensed to “Multiwealth Global”. Unauthorized use, duplication, or distribution of the Platform or its content is strictly prohibited.

 

11. No Warranty: The Platform is provided "as is" and "as available" without any warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. “Multiwealth Global” does not warrant that the Platform will be error-free, secure, or uninterrupted.

12. Indemnification: You agree to indemnify, defend, and hold harmless “Multiwealth Global”, its affiliates, officers, directors, employees, agents, and licensors from and against all claims, damages, liabilities, costs, and expenses, including legal fees, arising out of or related to your breach of these Terms of Use or misuse of the Platform.

13. Third-Party Links and Services: The Platform may contain links to third-party websites or services, which are not owned or controlled by “Multiwealth Global”. “Multiwealth Global” has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that “Multiwealth Global” shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

14. Account Termination: “Multiwealth Global” reserves the right to terminate or suspend your account without prior notice or liability, for any reason, including but not limited to, violation of these Terms.

15. Entire Agreement: These Terms of Use, together with the Privacy Policy and any other legal notices or terms published by “Multiwealth Global” on the Platform, constitute the entire agreement between you and “Multiwealth Global” concerning the use of the Platform.

16. Waiver and Severability: The failure of “Multiwealth Global” to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

17. Force Majeure: “Multiwealth Global” shall not be held liable for any delays, failure in performance, or interruption of service which result directly or indirectly from any cause or condition beyond its reasonable control, including but not limited to: utility failures, equipment malfunctions, natural disasters, strikes, civil disturbances, or any other cause or condition beyond “Multiwealth Global”'s reasonable control.

18. Acknowledgment of Electronic Transactions: The User acknowledges that by agreeing to this Terms of Use Agreement electronically, they are providing an electronic signature equivalent to a handwritten signature.

 

Liability Waiver Agreement 

This Liability Waiver Agreement (the “Agreement”) is entered into by and between the user ("User" or "You") and “Multiwealth Global”, an AI-based algo trading platform ("Platform", "We", "Our", or "Us").

By accepting the terms of this Agreement, the User acknowledges the inherent risks involved in trading and algorithmic trading strategies and agrees to the terms outlined below:

 

 

1. Acknowledgment of Risks

   1. The User acknowledges that trading in financial markets involves substantial risks, including the potential loss of invested capital. Additionally, the User expressly acknowledges being fully aware of the specific risks associated with the particular markets in which they choose to operate the strategies provided by “Multiwealth Global”.

2. No Financial Advice

   1. “Multiwealth Global” is a platform that provides algorithmic trading strategies and does not offer or provide financial, investment, or trading advice.

  2. Any information, tools, or services provided by the Platform should not be interpreted as investment recommendations or advice.

3. No Control Over User Funds

   1. “Multiwealth Global” does not, at any point, take control, custody, or possession of the User’s funds or investments.

4. No Guarantees or Warranties

   1. The Platform provides algorithmic trading strategies "as is" and "as available" without any guarantees or warranties of any kind.

  2. We do not warrant or guarantee the accuracy, completeness, reliability, or usefulness of the trading strategies, nor the profitability or success rate of these strategies.

5. Limitation of Liability

   1. To the fullest extent permitted by law, “Multiwealth Global” and its affiliates, partners, directors, employees, shareholders, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or related to the User's use of the Platform.

6. Indemnification

   1. The User agrees to indemnify, defend, and hold harmless “Multiwealth Global”, its directors, officers, employees, and agents from any and all claims, liabilities, damages, losses, costs, expenses, fees arising from the User's use of the Platform's strategies or violation of this Agreement.

7. Entire Agreement

   1. This Agreement, along with any supplemental agreements or terms specified by “Multiwealth Global”, constitutes the entire agreement between the User and “Multiwealth Global”.

8. Severability

   1. If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary.

9. Amendments

   1. “Multiwealth Global” reserves the right to amend or modify this Agreement at any time.

10. No Guarantee of Continuous Access

   1. “Multiwealth Global” does not guarantee uninterrupted, continuous, or secure access to the Platform.

 

11. Third-Party Tools and Integrations

   1. The Platform may employ third-party tools, software, or integrations. “Multiwealth Global” is not responsible for any errors, omissions, or malfunctions of such third-party tools.

12. Acknowledgment of Electronic Transactions

   1. The User acknowledges that by agreeing to this Liability Waiver electronically, they are providing an electronic signature equivalent to a handwritten signature.

13. Choice of Law and Jurisdiction

   1. This Agreement shall be governed by the laws of United Kingdom The User consents to the exclusive jurisdiction of the courts located in United Kingdom

14. Dispute Resolution

   1. Any disputes arising shall first be attempted to be resolved through amicable negotiations. If unsuccessful, disputes shall be resolved through arbitration in United Kingdom.

15. No Waiver

   1. The failure of “Multiwealth Global” to exercise or enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision.

16. Assignment

   1. Users may not assign or transfer any rights or obligations under this Agreement without prior written consent from “Multiwealth Global”. “Multiwealth Global” reserves the right to assign or transfer its rights and obligations.

17. Survival

   1. Provisions of this Agreement which by their nature should survive termination, including indemnification provisions, warranty disclaimers, and limitations of liability, shall remain in effect beyond any termination of this Agreement or cessation of use of the Platform.

 

ANTI-MONEY LAUNDERING (AML) USER AGREEMENT

“Multiwealth Global” ("the Platform") could offer an AI-based trading strategies to users via an API, allowing integration into individual trading accounts. Please carefully read and understand the following terms before using our services:

1. BACKGROUND: 

The Platform provides strategies and does engage in trading activities on behalf of the User. The Platform also does not hold funds for the User.

2. AML REPRESENTATIONS AND WARRANTIES:

1. By using our services, you represent and warrant that you will not use the strategies provided for any illegal or illicit activities, including, but not limited to, money laundering.

2. You agree to use the strategies in accordance with all relevant laws and regulations of your jurisdiction.

3. You acknowledge that while the Platform provides strategies, it neither endorses nor recommends specific trades or investments. All trading decisions are your responsibility.

3. PROHIBITED USES:

1. Using our strategies in connection with activities that are illegal and/or may tarnish the reputation of the Platform is strictly prohibited.

2. Manipulating or misusing the strategies to engage in market manipulation or any fraudulent trading activities is forbidden.

SOURCES OF FUNDS:

1 By using our services, you represent and warrant that all funds, securities, or digital assets that you use in connection with our strategies come from lawful sources and are not the proceeds of illegal or illicit activities.

2 The Platform reserves the right to suspend or terminate services to any user if there are reasonable grounds to suspect that the funds used by the user are from illicit or unauthorized sources, or if the user fails to provide evidence of the legitimacy of their funds upon request.

3 You agree to fully cooperate with any regulatory investigations or inquiries related to the sources of your funds used in connection with our strategies. This includes, but is not limited to, promptly providing all necessary documentation, information, or clarification as may be required by regulatory authorities to ascertain the legitimacy of the funds.

5. MONITORING:

1. The Platform may analyse the overall usage of its strategies to ensure compliance with this agreement.

2. Should we believe our strategies are being misused, we reserve the right to suspend or terminate your access.

6. COOPERATION WITH LAW ENFORCEMENT:

You agree to cooperate fully with any investigations related to the use or misuse of the Platform's strategies.

7. AMENDMENTS:

The Platform may periodically update this Agreement. Your continued use signifies acceptance of any changes made.

8. INDEMNIFICATION:

You agree to indemnify and hold the Platform harmless from any claims, damages, or losses resulting from misuse of our strategies or violation of this Agreement.

9. TERMINATION:

If found in violation of this Agreement or if your activities are deemed harmful, the Platform reserves the right to terminate your access.

10. GOVERNING LAW:

This Agreement is governed by the laws of United Kingdom. Disputes arising from this Agreement will be settled under the jurisdiction of the courts of United Kingdom.

11. ACKNOWLEDGEMENT:

By using the Platform's services, you acknowledge that you have read, understood, and agree to abide by this AML User Agreement.

12. Acknowledgment of Electronic Transactions (Entire Agreement)

These Terms, along with any additional terms or policies referenced herein or made available by hyperlink, constitute the entire agreement between “Multiwealth Global” and you pertaining to the subject matter, and it supersedes all prior or contemporaneous negotiations, discussions, or agreements, whether written or oral, between the parties regarding such subject matter.
